Driver Helping another Motorist Killed in a Burbank Car Crash

More often, Good Samaritans get nothing but gratitude and no injuries; however, the case of a Long Beach motorist is rather a different and tragic one.

A 55-year-old driver from Long Beach was killed while helping another motorist who had a flat tire in Ventura Freeway, Burbank, when a speeding Pontiac hit the Good Samaritan that resulted in his untimely death.

According to California Highway Patrol officials, the driver of the 2008 Pontiac G6 was heading westbound at about 65 miles per hour when he fatally struck the victim who had just finished changing a tire of another motorist.

The stranded driver on the other hand, sustained head injuries when the debris from the car crash hit him. According to news reports, the injured motorist was rushed into a hospital. CHP officials have said that the Pontiac driver was not injured and was not arrested.

In legal sense, the Pontiac driver if proven negligent may be charged with wrongful death lawsuit by the victim’s survivors. Under the tort law, in the event of a fatal car accident caused by the careless of another, the surviving relatives or family members of the deceased victim have the right to make a wrongful death claim.

Additionally, the driver of the stranded vehicle may file a personal injury case against the driver of the Pontiac, and may assert for compensation claims.

Pregnant Driver Suspected of DUI Injured by Drunk Driver

    This is pretty outrageous news.

In Montebello, a suspected drunk female driver who also happens to be pregnant was involved in a major car crash with another driver who also happens to be drunk.

According to the police, four people were injured in the vehicle collision which occurred at Whittier Boulevard and Concourse Avenue. One person was also reported to have been ejected from the vehicle because of the crash.

The drunk pregnant lady driver and the intoxicated male driver both incurred serious injuries. The man’s arms may be amputated because he suffered major trauma.

The police have said that the crash was triggered by the loss of control by one of the speeding vehicles. Lester Enrique Chupina of Whittier was booked for felony drunken driving and is being held at Montebello Jail for $100,000 bail.

The statistics of women driving under the influence are fast approaching the DUI figures which are usually dominated by men.

The National Highway Traffic Safety Administration in its 2008 study revealed that 1,650 people died in the United States because of an alcohol-impaired female driver.

Further, the NHTSA reported that women arrested for DUI, 35 percent had one or more passengers in the vehicle at the time of the crash. While most of the passengers are male, a substantial percentage of them are child passengers.

The increasing trend of female drunk drivers is indeed a cause for concern. Kids in particular are vulnerable because mothers are often tasked to pick up their children from school and if she’s drunk, a tragic accident will almost surely happen.

Usually, law enforcement officers are more lenient towards female drivers, likewise, most DUI campaigns also target men.

Female drivers should fall under the same degree of scrutiny of male drivers. Drunk driving is a vast and encompassing social problem that affects everyone, whether they are man, woman or a teenager.

Save Lives: More Caution, Less Speed

Yet another life is tragically lost on the road and once again, car accidents proved to not discriminate against its victims. Beth Smith, the wife of PGA Tour Player Chris Smith was killed and his two children grievously injured last June 22, 2009 in a car crash in Indiana.

It was reported that Beth Smith and their two teenage children, Abigail and Cameron were returning from a trip from Toledo, Ohio, when their SUV collided with a Greyhound bus transporting a Canadian semipro football team.

Police said that the SUV lost control in the passing lane on Interstate 69, over corrected and crossed the median into the northbound lane.

The crash killed Beth and Abigail and Cameron Smith, were listed in critical condition at Fort Wayne's Lutheran Hospital. About 12 passengers on the bus were treated for minor injuries at a local hospital.

94 percent of the 10.6 million vehicles involved in motor vehicle crashes in 2007 are passenger cars and light trucks (pickups, vans, and utility vehicles).

A 1995 Insurance Institute for Highway Safety study showed that swerving into another occupied lane account for 13 percent of all fatal crashes while turning left and colliding with an oncoming vehicle comprise 9 percent of traffic fatalities.

While statistics show that the Smith’s choice of vehicle as well as the conditions surrounding the accident that death and injury are almost a surety— motor vehicle related deaths are still considered as the most preventable deaths.

A little more caution and less speed could have avoided the Smith’s fatal crash. Loss of control of one’s vehicle is easily one of the leading causes of car crashes and most of this boils down to human error and driver error.

Navigating on freeways and intersections require the driver’s utmost concentration because of the sheer number of vehicles as well as the presence of stops, turns, and lanes.

A little more caution and a lot less speed could save countless lives. Cameron and Abigail have lost their mother, and everybody else is at the risk of losing beloved family members because of a driver’s mistake.

Elderly man smashes car into restaurant

Driving is a skill. It involves focus, attention and physical stability.

An elderly man driving a car may lack the driving skills he once possessed. He may be disoriented and be oblivious to the surroundings.

A perfect example for this was the car crash that happened in Redondo Beach where an 88-year old man mistook the accelerator for the brake.

The elderly driver was apparently trying to park his Jaguar outside Ham Supreme restaurant near Pacific Coast Highway and Carnelian Street when he committed the error which led to the crash. His car hit pedestrians on the sidewalk before smashing through the restaurant’s window.

The car hit several diners including a woman who was pinned against the wall of an adjoining business. Some diners were trapped inside. In fact, the rescuers had to smash a front window to free the restaurant patrons.

Authorities must review rules and regulation concerning elderly drivers. Although victims sustained only minor injuries, the incident could have been worse.

As the elderly driver admitted his fault, the victims and their families have the right to sue him. Their claims may be settled or pursued by a personal injury attorney.
